2010: The Anatomy of a Train Wreck

The 2010 train wreck was placed on the tracks in 2001, when Congress passed EGTRRA and included a one year repeal of the estate and GST taxes and introduction of a modified carryover basis regime in 2009, followed by a sunset provision that caused reversion to pre-EGTRRA law on 1/1/2011. Unfortunately, Congress did not change the law, and the train wreck that was never supposed to occur did. At least four major factors are complicating the estate planner's life now.
