Carolyn Schenck Weighs in on IRS-CI Chief’s Comments Regarding the Voluntary Disclosure Practice in Bloomberg Law
The IRS is heeding calls from the tax industry and is overhauling a disclosure program that could tempt tax evaders to pay up.
The agency plans to revamp its criminal voluntary disclosure program — which allows some taxpayers to turn themselves in for tax crimes in exchange for a pass on criminal prosecution — after it saw low uptake among taxpayers. It’s an update that started in December 2025 after the agency announced its intention to change the program and sought feedback.

The program also is meant to free up the IRS to focus resources elsewhere.
“More agents and examiners will be able to focus on noncompliant taxpayers who aren’t coming forward,” said Carolyn Schenck, a Member at Caplin & Drysdale and former IRS counsel.
