Mark Matthews Speaks to Law360 on IRS Redesign and Criminal Investigation Division

A push to increase the clout of the IRS Criminal Investigation Division to help it manage expanded duties has gained traction on Capitol Hill as lawmakers await a Treasury recommendation on whether the division should report directly to the commissioner.

Mark Matthews, a former CI chief and IRS deputy commissioner for services and enforcement, told Law360 he doubted that putting CI under Rettig would increase the division's share of enforcement funding, which also covers audits and collections. He said the CI chief already has access to both Lough and Rettig.

“It could make a difference, but I don’t think in most budget years it would make any difference at all. And it would be more bureaucratically complex and awkward to have the CI chief equal to the two deputy commissioners,” said Matthews, a Member of Caplin & Drysdale.
